Review of the Public Trust Office Act 1975 | Iloiloga o Tulafono o le Ofisa Tausi Mavaega 1975

The Public Trust Office requested the Commission to review its governing legislation, the Public Trust Office Act 1975. On date, the Minister for the Commission approved the Terms of Reference (TOR) for this project. The TOR required the Commission to:  
 
a) Undertake research and analysis of the PTO Act 1975 to clarify the functions and operations of the Public Trust Office; and 
b) Identify any other relevant legislation in the fabric of laws of Samoa that needs to be considered in this Review, and 
c) Carry out comparative research and analysis into some overseas jurisdiction trust laws and best practices which may be applicable to Samoa’s needs and context; and 
d) Recommend necessary legislative reforms to update and clarify the functions and operations of the Public Trust Office. 
 
The SLRC completed its Discussion Paper in April 2026 and subsequently carried out public consultations from the 13th to the 29th of May 2026, across both Savaii and Upolu islands. The Commission will soon meet with key stakeholders for this review, before carrying out further research and analysis and preparing the Final Report.

Review of Traffic Laws of Samoa | Iloiloga o Tulafono o Taavale e Feoai I Luga o Ala Tetele a Samoa

Upon the Commission’s proposal, the former Prime Minister approved a Terms of Reference (TOR) on 29 July 2019 for the Commission to conduct a full review of the Traffic Laws of Samoa. The TOR required the Commission to:

  1. Collect and collate all traffic laws of Samoa;
  2. Carry out research and review those laws against the current systems, practices and context of Samoa, and against overseas best practices; and
  3. Make recommendations on updated traffic laws of Samoa, in form and in context, taking into account the current circumstances of Samoa.

The SLRC carried out public consultations on this review from the 24th of May to the 8th of June 2023, in both Savaii and Upolu islands. SLRC is currently in Stage 5 of this important project: the further research and analysis stage (post-consultations), and hopes to complete the Final Report on this review by early 2024.

Review of the Arms Ordinance 1960 | Ilologa o le Tulafono o Aupega 1960 a Samoa

The Ministry of Police requested the SLRC to conduct a full review the Arms Ordinance 1960 (AO1960) to be updated with current practices. The Ministry noted the need to have a good working legal framework for arms matters that will make our small country a bit safer. In 2021, the Attorney General endorsed the Terms of Reference (TOR) for this project. This TOR required the Commission to:

  1. To carry out a full review of the Arms Ordinance 1960;
  2. To research and review related local and overseas laws and practices for analysis;
  3. To make recommendations on an appropriate framework for Samoa

The SLRC has just finalised its Discussion Paper on this important review, and intends to carry out public consultations over November and December of 2023.
